Welcome to Ladakh 365. These Terms and Conditions outline the rules and regulations for the use of our services and website located at ladakh365.com.
1. Booking and Payment
- Confirmation: A booking is considered confirmed only upon receipt of the initial deposit as specified at the time of inquiry.
- Balance Payment: The remaining balance must be cleared before the commencement of the tour or rental period.
- Pricing: All prices are subject to change based on government taxes, fuel hikes, or permit fee revisions.
2. Cancellation and Refund Policy
- Standard Tours: Cancellations made 30 days prior to arrival are subject to a 25% retention fee.
- Adventure Expeditions: Due to the logistics of mountaineering and trekking, specific cancellation tiers will apply as outlined in your specific itinerary.
- No-Show: No refunds will be provided for late arrivals or unused services once the tour has started.
3. Mountaineering and High-Altitude Activities
- Health Declaration: Participants must be physically fit and disclose any pre-existing medical conditions.
- Risk Acknowledgment: Clients acknowledge that high-altitude trekking and peak climbing involve inherent risks, including Acute Mountain Sickness (AMS). Ladakh 365 is not liable for illness or injury resulting from altitude.
- Guide Authority: The decision of the lead guide or expedition leader is final in matters of safety and route changes.
4. Motorcycle Rental and Touring
- Documentation: A valid driving license (International Driving Permit for foreigners) is mandatory.
- Vehicle Damage: The client is responsible for any mechanical or physical damage to the motorcycle caused by negligence or accidents during the rental period.
- Security Deposit: A refundable security deposit may be required for all motorcycle rentals.
5. Permits and Documentation
- Ladakh 365 will facilitate Inner Line Permits (ILP) and trekking permits; however, approval is subject to government regulations.
- Clients must carry original ID proofs (Aadhar/Passport) at all times during the journey.
6. Changes to Itinerary
- Ladakh is a weather-sensitive region. We reserve the right to modify itineraries due to landslides, road blocks, weather conditions, or government restrictions.
- Any additional costs incurred due to such unforeseen delays (extra hotel stays, flight changes) will be borne by the client.
7. Limitation of Liability
Ladakh 365 acts as an intermediary between the traveler and service providers (hotels, airlines, transporters). We shall not be held responsible for:
- Personal injury, illness, or loss of life.
- Loss of personal baggage or belongings.
- Delays or disruptions caused by natural disasters or political instability.
8. Governing Law
These terms are governed by and construed in accordance with the laws of the Union Territory of Ladakh, India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Leh.
Note: For adventure travel, it is highly recommended that you include a clause requiring all clients to have comprehensive travel insurance that covers high-altitude rescue and medical evacuation.
